Time for a Litmus Test — or Three

Sandra Day O'Connor has resigned as Associate Justice of the Supreme Court. And as we gear up for the confirmation hearing for her successor, let's stiffen spines and confront the absolute necessity for a litmus test or three.

The first, of course, is Roe v. Wade. That's been the subtext of every confirmation hearing in recent memory. Time to make it text, period.

Then there is the slipperier but equally crucial test of the nominee's stance on the wall between church and state.

The third? Prisoner rights, for want of a better term, especially if Alberto Gonzales is the nominee.

What is curious is that conservatives the Radical Right, too, are is asking for a litmus test — does Roe v. Wade turn the nominee's paper blue or pink. Except, of course, the Radical Right wants a different answer from the one we must demand. The pundits are saying this morning that the Radical Right is unhappy with Gonzales because he supported abortion rights during his term on the Texas bench. In other words, Alberto "Torture Memo" Gonzales is seen, in Radical Right circles, as unacceptably "moderate."

Robert Bork called in to CNN and delivered himself of a rather uncomplimentary assessment of O'Connor. (He may be smart, but he sure is no gentleman.) He also still sounds bitter at worst, testy at best, in recollecting his own defeat. We dodged a bullet on that one. Let's make damned sure we dodge another one this time around, even if dodging a bullet means unleashing a nuclear device.

We are in real trouble. If Rehnquist retires too, we might have to kiss Miranda good bye.

We're in a tactical bind. If we spend our energies on the O'Connor replacement, what will we have in reserve for the Rehnquist replacement?

Look to the the Thugs to scream at the top of their little lungs about "obstructionism", up-or-down votes, blah-de-blah blah blah.

They'll look to make public-approval hay over Democrats tying up government business as the process draws out over the weeks and months.

Not that there is any alternative to the fight, if we're supposed to actually stand for something.

There are no quick fixes or calvary rescues for us here. Democrats will have to do what the Thugs have done over the course of the last 40 years.

In fact, it was 41 years ago that I was travelling on tour through the Southwest and was mystified by the billboards that loomed over every highway: "Impeach Earl Warren!"

As a young teenager from NY, I had no idea who Earl Warren was or why he should be impeached. I soon found out.

Since those days, the Thugs and their racist, Dominionist enablers have worked tirelessly to capture one judgeship after another, until the entire Federal judiciary is riddled with their co-conspirators.

When they finally had the presidency, they approached the task of SCOTUS nominees with consummate guile and audaciousness. Their game plan has been simple and effective: Nominate the worst of the worst, then after the screaming dies down, settle for the next-worse. Each time, the goal post is moved to the right, until someone like Sandra Day O'Connor could be termed a moderate upon her retirement.
